D&I assisted the Finnish
Competition Authority (FCA) that for the first time involved an
outside litigation counsel to assist in the largest Finnish cartel
case to date. The Market Court's 2007 decision was appealed by
the FCA and six asphalt companies. The FCA's appeal to increase
the infringement fine was approved almost as such. The infringement
fines imposed on the asphalt companies by the Market Court were
multiplied by the Supreme Administrative Court to EUR 82.55 million.
The appeals made by the asphalt companies were dismissed.
D&I assisted Eurocash Oy, an independent ATM
operator, in an investigation by the FCA relating to alleged abuse
of joint dominant position of Automatia Pankkiautomaatit Oy and
certain Finnish banks which own Automatia. Automatia operates
the national OTTO ATM system. In June 2009 the FCA gave a settlement
decision in which the banks agreed to lower the fees charged from
consumers for using other than OTTO ATM's.
D&I represented Suomen Numeropalvelu - Finlands
Nummertjänst, a national provider of wholesale telephone
directory information, against allegations of abuse through unjustified
refusal to provide directory information to Eniro for purposes
of free internet distribution. The Market Court upheld SNOY's
right to refuse after the relevant data protection directive was
implemented. The case is currently pending in the Supreme Administrative
Court.
D&I represents one
of five Finnish motor vehicle spare part wholesalers alleged to
have participated in concerted practice and collective boycott
towards one customer chain. The case is currently pending in the
Supreme Administrative Court. Additionally, a competing wholesaler
claims joint and several compensation of approximately EUR 65
million based on damages from the cartel in a public court of
law.
