Representing GS Balance in a complex procurement dispute before the Market Court

We successfully represented GS Balance, a pioneering health technology company, before the Market Court in complex appeal proceedings concerning the procurement of a medical device.

Following our appeal, the contracting authority issued a decision to suspend the procurement procedure. The complexity of the case was underscored by sector-specific legislation, in particular the Medical Devices Regulation, as well as issues relating to the calculation of the estimated value of the procurement and, consequently, the admissibility of the appeal.

The Market Court ruled on these questions in our client's favour and held that the client had valid grounds for appeal. Subsequently, the Market Court ordered the contracting authority to bear a significant portion of our client’s legal costs.
