Successfully defending the Finnish Digital and Population Data Services Agency’s procurement decision before the Market Court
We represented the Finnish Digital and Population Data Services Agency (DVV), the public authority responsible for Suomi.fi, Finland's national digital public services platform, against an unsuccessful tenderer in an appeal procedure before the Market Court. The case concerned the procurement of printing, enveloping and distribution services for the Suomi.fi Messages service, valued at an estimated EUR 42 million.
The Market Court held that DVV had not exceeded its discretion and had not acted contrary to the procurement rules by not requesting the winning tenderer to clarify its allegedly abnormally low-seeming price. The appeal was dismissed in its entirety, and the appellant was ordered to cover the greater part of our client's legal costs.
